Cape Town - SA’ Mobicel Air smartphone may resemble the iPhone but does not infringe European patent rules, according to an expert of the local company. People noticed that the Air range of devices are similar to Apple’s iPhones. According to Benoit Battistelli, president of the European Patent Office, the design can be copied because it was not protected by patents under European laws. Rules concerning designs are valid for five years and can be extended for another five years. Ultimately, the look and feel of a smartphone is difficult to describe as a patent. Patent issues have been causing great battles between Apple and Samsung when Galaxy S infringed on some of the iPhone’s patents. The disputed ended in a R11b settlement.
